How do you get a lawyer to file a class action lawsuite?I have a problem with BellSouth/AT&T on a bill.?
I signed up for service on a Monday, canceled on Wednesday. They sent me a bill for $83.16 saying there is a cancelation fee. I was not given that information prior to signing up, nor was I told when I called to cancel. They never came to install service and yet keep sending me a bill. I have written them letters stating I want to hear the tape of the conversation since they said the call was monitored and they have not given me any such tape. I just KNOW there are other consumers who have gone through the same thing. I think something should be done about this. I have been writting to them and at one time someone called me and said I would be getting a credit, however two months passed and then I just received another bill for over $100. Someone please help me!
You know... your best bet may be to take them to small claims court.
Your problem isn't typical... I doubt it comes up that frequently (two days from sign up to cancellation).
The problem is when you sign up, you signed a contract. You may not realize it, but when you signed up for service, (in person they use a little computer screen, but it sounds like you did it by phone and are being held by a verbal agreement) you agreed to all their policies and such.
However, it sounds like they're aware of the fact that despite the signing of the contract, service was not provided (never hooked you up). Call up again. Get the name of a person who states you're getting the credit. Ask them to fax/send you a copy of the cancelled contract with the credit. Relax, these things take time. Once you get the paperwork showing they agreed to cancel the contract, you can take appropriate steps (send a copy to billing, to any creditors who might later try to collect).
The important thing is to be polite and agreeable when you call up. You DID enter a contract, and by law, you're responsible for fulfilling it. Since you cancelled it, they aren't at fault. They're doing you a favor by letting you back out. (I know this sucks, but they're VERY protected in this). Definitely get that name of whoever agrees to the refund.
If you can't get someone to do all this, you can try small claims court. You MIGHT win based on the fact that they hadn't shown up to install yet, but I think according to contract law, you're liable for the cancellation fee.
